A felony charge of rape has been dismissed in the case of Rene Rodriguez, a former Blaine County sheriff’s deputy and former Lincoln County sheriff who is now facing six felony charges of sexual contact with a minor.

     During a pretrial conference today, 5th District Judge Ned Williamson stated that one of the two felony rape charges was being dismissed by the prosecution, as it was discovered that the alleged incident occurred outside of the five-year statute of limitations. Rodriguez still faces four counts of lewd conduct with a minor under 16, one count of sexual abuse of a minor under 16 and one count of rape, all alleged to have occurred while the alleged victim was between 9 and 17 years old.

     The jury trial is scheduled to begin Nov. 19 and is currently scheduled to last five days.
