Defendant accused of ‘inappropriate behavior’ with child

A 37-year-old Hailey man has been indicted by a Blaine County grand jury on felony sex crimes for alleged “inappropriate behavior” with a female acquaintance under the age of 16.
Harry M. Motzkin II was arraigned on two counts of sexual abuse of a minor on Monday in Blaine County 5th District Court. He pleaded not guilty to both charges. A three-day jury trial was scheduled to begin on Jan. 28, 2014.
The crime of sexual abuse of a minor is punishable in Idaho by up to 25 years in prison.
The indictment against Motzkin was issued on Sept. 11 after a grand jury was convened by the Blaine County Prosecuting Attorney’s Office.
Motzkin is accused of committing the crimes in May.
“The allegation is there were two occasions of inappropriate behavior,” Hailey police Lt. Steve England said Tuesday.
More specifically, England said that Motzkin allegedly “exposed himself” to the girl on two occasions.
Motzkin was originally charged in June with two lesser crimes, misdemeanor injury to a child and misdemeanor disseminating inappropriate material to a minor.
However, England said the prosecutor’s office decided to take the case to a grand jury after further review of the case and additional investigation following the initial filing of the two misdemeanor charges.
Motzkin is currently free on $30,000 bond. He is represented by Hailey attorney Selim Star.
