Immigration raid leads to federal lawsuit

Bellevue family claims civil rights violated in 2007

Almost two years after a federal immigration raid in Blaine County, a Bellevue family claims that it is still suffering emotional distress from what the family alleges was an illegal search of their home.

"I am still totally upset because we were treated like we were in Iraq or something," said Dana Ayala, a Filipino native and U.S. citizen who has lived in the Wood River Valley since 1991. "They had no warrant when they barged into our house."

Ayala, her husband, Jesse, and their three children have now filed a lawsuit in U.S. District Court in Boise claiming that their civil rights were violated on Sept. 15, 2007. Named as defendants in the suit are the U.S. Department of Homeland Security, the federal Immigration and Customs Enforcement agency and the Blaine County Sheriff's Office.

Sheriff Walt Femling said Tuesday that he expects that his office will be removed from the lawsuit because deputies acted only as observers and were not participants in the searches and arrests made that day by federal ICE agents.

The Ayala's mobile home on Broadford Road in Bellevue was one of numerous locations visited by ICE agents in the raid. Searches and arrests were also made in Ketchum and Hailey. ICE officials reported in 2007 that 22 alleged illegal immigrants were taken into custody in Blaine County during the raid. Some of them were wanted on fugitive immigration warrants, while others were illegal immigrants encountered during the searches. Thirteen of the suspects were Peruvian and the other nine were Mexican.

ICE officials declined to release the name of the man they were searching for at the Ayalas' home, but Dana Ayala identified him as Luis Gonzales, someone she didn't know and who had never stayed at her home.

The lawsuit was filed on behalf of the Ayalas by Hailey attorneys Keith Roark and Kevin Cassidy. The complaint alleges that the defendants violated the Ayalas' constitutional rights, illegally detained them, illegally inflicted emotional distress and illegally battered some of the family members.

The lawsuit alleges that the defendants suffered "severe emotional distress, mental anguish, indignation, wounded pride, shame and despair." The Ayalas are seeking unspecified monetary damages.

"The home was searched and they were detained without a search warrant," Cassidy said Tuesday. "There was no one illegal in the home. They were all U.S. citizens or legal residents. It was traumatizing to them. They were extremely violated by the event.

"This was something that needed to be brought to the community's attention, that this sort of egregious behavior takes place."

Dana Ayala said ICE agents pounded on the door at 6:30 a.m., barged into the home after her 19-year-old son opened the door, traumatized the family and searched the home without permission.

She said agents entered with guns drawn and shoved both her son and husband onto a couch. The agents searched the home for about 35 minutes.

Ayala said her husband, Jesse, is a Mexican native with legal residency in the U.S. and that the couple's three children are U.S. citizens.

"I'm still angry," Ayala said. "I'm still angry about everything. You can't go into people's houses without a warrant."

She alleged that ICE agents used "racial profiling" in identifying the Ayala home as a place to search.

ICE spokeswoman Lori Dankers said Tuesday that she is unable to comment on pending litigation.

Femling said his officers were only observers and not participants. He said Sgt. Bryan Carpita was at the Ayala home that morning and reported that ICE agents conducted the search in a professional manner.

Femling said ICE had "several criminal alien warrants" and had information that one of the suspects it was seeking was staying at the Ayala home.

"They went in and they searched and he wasn't there so they left," Femling said. "His (Carpita's) report showed that they acted very professionally in what they did and that there was no incident at all."

Femling said he was in northern Idaho at a state sheriffs' meeting at the time of the raid and wasn't involved directly.

"We usually ask the feds, as a courtesy, to let us know when they're in the county working," Femling said. "That's what they did that day and we had officers along as observers."

you have me wrong, what im sayin is some of us have jobs we cant just say no to . I served my country for 13 years before i took this job so theres another example of a job you cant just quit. and not all cops are raciest or one sided.and unfortunalty this stuff does happen to good people but we are not perfect.if you saw how much of your hard earned money went to pay for non citizens and when our own cant even get help it would make u sick. oh and im not a obama supporter.

for the record karen i believe that this is the same law suit that has been on going for the past two years. the family did not wait to file they filed shortly after it happened
and justice will prevail this family has been wronged and i hope they prove their claim at trial

until you serve as law enforcement you have no reason to cast judgement, we follow orders. those of you who throw the race card well the white american is now the minority so dont go there. unfortunety there are attorneys out there (not all) that jump at the chance to make a buck, in the end we all pay for this. people only hate cops until they need us. as for me i will continue to serve unbias.

Your orders must conform to the US Constitution, which you have sworn to uphold and defend. Any superior deviating from that document is guilty of treason. The entire Constitution and related documents are contained in a pocket size book: www.amazon.com . Read some of it every day until you have it memorized, especially the first ten Amendments. It is the law of the land. Your only "bias" is to uphold the Constitution and defend it from all enemies, foreign and DOMESTIC.

I am outraged that this family was terrorized in the name of "law enforcement." I still believe our country was founded on beliefs clearly aimed to prevent this sort of thing. We CANNOT accept this violation of civil rights in our community. As for why these folks did not sue earlier, I completely understand - it takes a lot of courage to sue law enforcement, especially in a small town. I commend this family for their courage - in a very real way, they are fighting for all of us.

what happened to the last law suit the Ayala family had? give it up. stop wasting tax payers money. I'm sure they know best and wouldn't go in peoples homes without a reason nonethelss a warrant. Everyone is tramatized when when any agents go in to peoples house. should everyone sue?

If they were Caucasian would this change how you feel? By the past racist, bias, and ignorant comments you have made in the past, I believe it would change your attitude. I know this family and they are good people. No one should have to fall victim to mistaken identity. In the original article it clearly stated there was a mix-up in addresses, or the people being looked for had listed this family's address, but did not live there and this family was not the one's wanted for questioning. This family is legal and according to our constitution it is illegal what this family had to endure was wrong. To be pushed, shoved, thrown on the ground, insulted, humiliated is morally wrong and the violence they suffered is illegal...even if the perpetrators are wearing badges. And from my understanding it was their son's choice to wait. He was a senior in High School at the time, and didn't want this pressure added to his plate. He is the one who suffered the majority of these agents cruelness - from what I understood.

Absolutely. If you have ever dealt with law enforcement that disregarded your rights, you should sue. They answer to us. Or at least they should. If you have ever had them (law enforcement ) kick in your door, then treat you like an animal, then leave like nothing ever happened, you would be angry too. I bet you would get F. lee Bailey to defend your right to quiet enjoyment of your own home. I don't know what happened, I wasn't there. But if there is any credibility to what they claim, there should be some recourse for them.

Not sure I believe this. Why would they wait 2 years to file? My guess is they have a lawyer friend who saw an opportunity to dig into the government's pockets and made up a story. Obviously, if the complaint is valid, we've got a real problem - but everybody is having a ball demonizing immigration enforcement efforts. I only hope the truth wins out in this case, whatever it may be.

My guess is the victim of this crime's lawyer had a difficult discovery process attempting to obtain federal and local "law enforcement" documents in this home of the brave and land of the free police state..

What is really outrageous is the Sheriff Mr. Walt Femling has more authority in his jurisdiction than the feds do, even than the president does..Not only should the BCSO be included in the suit..so should be listed in this suit also-The Sheriff..as well he should resign, He held up his right hand and swore to uphold the State and Federal Constitutions..Which gives him the power mentioned above to stop federal agents from violating not only the Constitution of the state of Idaho, but our federal constitution as well..Not to stand around observing while these enemy's of the people ransack his county's home owners homes...You need a sheriff in Blaine county not another federal puppet on a leash..
