Immigration agents seize 20 suspected illegal aliens

ACLU investigating to see if civil rights were violated

By TERRY SMITH
Express Staff Writer

Federal immigration officers descended on the Wood River Valley over the weekend and scooped up some 20 people who are suspected of being illegal immigrants.

The raid by Immigration and Customs Enforcement officers has left a bitter taste in the mouths of at least one Blaine County family, and the American Civil Liberties Union of Idaho is investigating to see if civil rights were violated.

ICE officials have declined to comment on the raid, but Blaine County Sheriff's Detective Steve Harkins said the federal agents were from a "special fugitive unit" out of Boise that was searching for non-native convicted felons who have returned to the United States illegally.

Harkins, who wasn't directly involved in the raid, said Tuesday that he heard 21 people were arrested. Ketchum police spokesman Kim Rogers put the number at 20. She described some of the detainees as "Peruvian."

Harkins explained that not all the people arrested are necessarily convicted felons, since in the course of raids ICE agents will detain other suspects who are unable to demonstrate that they are U.S. citizens or legal residents.

Neither the sheriff's office nor Ketchum police were directly involved in the operation, but both local agencies assigned officers as uniformed escorts.

"As far as the actual operation, that wasn't us," said Ketchum Assistant Police Chief Mike McNeil. "All I know is they came in and requested our assistance."

ICE agents in unmarked white or black sport-utility vehicles were seen conducting pre-dawn raids in Ketchum and Bellevue on Saturday morning at about 6:30 a.m.

A Bellevue woman said ICE agents showed up at her door at the Westwood Mobile Home Park at about that time.

"They pounded on my door so hard that my walls shook," said Dana Ayala, a Filipino native and U.S. citizen who has lived in the Wood River Valley for 13 years. "My 19-year-old son opened the door to see what was the matter and six agents pushed their way into my home.

"They never informed us who they were, they just barged into our house. They never showed us a warrant."

Ayala said the agents later told her that they were looking for a "sexual predator" by the name of Luis Gonzales, someone she had never heard of and had never lived in her home.

"I have two teenage daughters," she said. "I'm not going to let a pedophile stay here."

Ayala said her children are U.S. citizens and her husband is a Mexican native who has legal residency in the United States.

She said the agents searched the home and questioned the occupants for about half an hour, were rude and abrupt and have left her family traumatized, especially her 18-year-old daughter who is mentally retarded.

"I would say that they're Cracker Jack cops," said Ayala. "You don't treat citizens that way. Not even so much as an apology. That's crazy. If they would have contacted the Bellevue Marshal's Office first they would have known who we are."

Jack Van Valkenburgh, executive director of ACLU of Idaho, said the ACLU is investigating the raid to determine if civil rights were violated.

"You don't have to be a citizen to have many of the constitutional rights afforded by the Bill of Rights," he said. "You can't vote, but you still have protection from unlawful search and seizures."

He said ICE agents are required to have search warrants and that people detained or questioned by the agents have the right to an attorney.

This is to Lisette ...... Explain to me where it's ethical to hire illegals so you don't have to pay reasonable wages to hard working people. Maybe you should take a look within.

I don't believe Immigration raids people house without a reason. If they went in Dana house was for a very good reason.

carol in response to your comment they did enter with a very good reason but it didn't apply to us they were looking for a sexual predator that supposedly lives at my residence for 2 years we have lived here for 13 years and do not know of such a person. the sheriff department needs to get their fact straight before they terrorize people we have lived in the valley for 16 years so get informed before you open your mouth.

I agree with Carol if ICE raided her house was because they were sure the person they were looking for was either living there or staying.

There has only been one side of the story told. ICE just doesn't barge into houses. There was some reason they were at this particular home. Does the woman know who her daughters are seeing/meeting/dating??
Anything that is done to help stop this illegal alien mess is welcome. And the ACLU is not helping to solve the problems that are occuring nationwide. They really do need to change their name..American ?? It is getting ludicrous that that is part of their name.

I would love it if each of you would take a second to step back and think of what you are saying. There is two sides to this story. One is the legal side and the other is the idea of an immigrant. We are almost all immigrants, some of us first generation, some third, but in most scenarios, we all immigrated from another country. The beauty of the United states should be the ability to immigrate here, work hard and be afforded the rights of every other citizen. I understand that some people are not afforded the opportunity to come to the US legally, so some of them come and try their luck anyway. Having illegal immigrants deported is legal, and should not be the issue here. The issue is the way in which immigrants are stereotyped and believed to be illegal without any just reasoning. We all must remember that illegal or not, these people are innocent until proven guilty. I think that every one can say that they would feel violated if the ICE came into their home and treated them as the Ayala's were treated. Please understand that, wonderfully, the United States is a melting pot of ethnicities and that just because people are of a different race or have different cultural background, doesn't mean they belong any more or less than the next US citizen.

That's all very sweet and nice but also extremely clueless. Going back to the original topic of the article, the ICE were searching for a SEXUAL PREDATOR. I am very supportive of the way they handled this situation, regardless of who's home they were invading. You can live in your little bubble of love and melting pots but I, for one, am going to fight for the freedom for my children's sake to keep their world that I brought them into safe from all the wackos out there.

"realamerican" says "criminals need to be reprimanded." Excuse me? Reprimanded? You mean, receive a mild scolding and no dessert for a week? Criminals need to be incarcerated or DEPORTED! Preferably, both of the above. They contribute very little. I already know how to scrub a toilet, clean house and operate a leaf blower. The ONLY people who benefit from this colonization of the United States by illegal foreign national aliens are politicians who would pimp their own mother out for a vote from this new and perceived "Bloc of voters" and contractors/homeowners who hire them illegally to save a few bucks. DEPORT!

lol...funny thing....not ALL criminals can be DEPORTED unfortunately. Those who are citizens or residents or legally in this country (whatever) get the privelege to be incarcerated and stay in the country with ALL amenities paid for(gym, schooling, room, food). Who do you think continues to pay for their 3,600 night stay in prison???? THOSE CRIMINALS are really the ones that contribute to nothing but higher TAXES for working people. BTW---answering a phone is A LOT easier than scrubbing a toilet and still there is a high demand for individuals who can answer phones! I think you should respect people's careers because (although it's hard to believe) people OWN very SUCCESSFUL companies that employ people who clean homes, toilets, and do dirty laundry!

The reality of the matter is the Sun Valley are has changed dramatically in the last 5-10 years. Some would say for the worst, main street hailey and Ketchum has stores stores that are geared for the non citizens. Low income housing is being constructed. Crime is still low, but increasing. As a citizen of blaine county you have the right to embrace the change of this once quiet ski area, or protect and conserve the area by supporting those that up hold the law.

I don't know what main street you are walking down, but the stores down main street in Ketchum and Hailey are not geared toward non citizens. They are upscale mom and pop stores that have been part of the valley for several years.

We all need to learn to change with the times. Change is what has allowed us to go into space and create the techological advances everyone currently enjoys. What people need to concentrate on is the fact that a family's civil rights have been violated. This is a family that has been a part of the community for many years.

Our laws were created to protect us from being falsely accused. Noone, not a police officer, FBI or CIA agent, or ICE official, or common citizen has a right to enter someone's home without a search warrant. Anybody would be offended and taking legal action against an organization or individual that takes it upon themselves to invade his home without the proper documentation. Since when did our government become an authoritarian government?

Something does need to be done about the immigrants entering this country illegally. Criminals do need to be reprimended. Yet, not all criminals are immigrants. A perfect example is the Idaho Senator. He is not an illegal immigrant but he has commited a crime. Is he representing all of Idaho?

Let's focus and be calm. Neither the ACLU or those on the other side of the spectrum who want the immigration laws of the US obeyed or enforced, are terrorist lovers or fascists respectively. What we all want in the US is a middle ground where both immigrants and law enforcement officers obey the laws and constitutional rights afforded by the Constitution. The same that we ask from immigrants we must expect from our law enforcement agencies. Immigrants in many instances understand that they are taking a risk by not following immigration laws. But that cannot translate to their mistreatment by Immigration and Customs Enforcement agents. ICE cannot walk into a home without a warrant, abuse its occupants physically or verbally, or terrorize neighborhoods because its residents look a certain way. The US has fought too many wars were too many have died for our Constitution--including thousands of non-citizens who have volunteer to safeguard the American way. Constitutional violations shall never be taken lightly; that is the American way.

I am a Mexican American, born and race in the United States, I have seen my family strugle, work, and sufer their way thru. And maybe is true that a lot of mexicans come here to the U.S. to make trouble, but not only mexicans kill, not only mexicans steal or sell drugs, we've always had murders, thefs, and drug dealers in the U.S. so why now try to blame an inocent that is tring to put food on his table for his family, that builded your home, that takes care of your children while you work, that pretty much takes any job we dont want.

Why do you folks always cry racist? This has nothing to do with race, but it has a whole lot to do with the rule of law and the respect of this nation and it's citizens. Go ICE.

Enforcing the Constitution of the United States is as patriotic as one can get. I admire the ACLU for doing so. Many people are being affected, undocumented, legal permanent residents, refugees, citizens. Our constitutional rights are being eroded more and more everyday as immigrants are scapegoated for the ills of this country.

I hate it when 1 or 2 people get on these comment pages and call others racist when they don't even know them and when people express their 1st ammendment right they are labeled a racist..And iknow how the real world works I am 46 years old and make less money today than i did 6 years ago due to the influx of Illegal aliens. The fact that you are making less money now than 6 years ago sounds like a personal problem to me. It doesn't happen to individuals who are successful. In reference to the 1st amendment right....it's ok to express your feelings. It boils down to being ethical...and that lies within each one of us.
